In order to download and use the logos, graphics and typography available from the Identity Resources Web site, you must first read and accept the terms of this Agreement, and confirm your acceptance of the terms of this Agreement by clicking “I Accept” at the bottom of this screen.

IF YOU CLICK “I DO NOT ACCEPT” YOU WILL NOT BE ABLE TO DOWNLOAD THE LOGOS, GRAPHICS, SYMBOLS, IMAGES, PHOTOGRAPHS OR TYPOGRAPHY (HEREIN AFTER “UC BERKELEY IP”).

“University of California, Berkeley” and all related names, logos, seals, photographs, typography, symbols and other images referring to the University of California Berkeley (e.g., trademarks & copyrighted material) are the property of the Regents of the University of California (herein after “The Regents”). Any use of the UC Berkeley IP requires an Agreement (license) from The Regents.

1. License Terms

1.1 Subject to all the terms of this Agreement, The Regents grants you a limited, non-exclusive, personal, non-sublicensable, non-assignable license to use the logos, symbols, photographs, graphics and typographies (“UC Berkeley IP”) available on the University of California Berkeley Identity Resources Web site (“IRW”).

1.2 Use of the UC Berkeley marks are subject to all of the terms of this Agreement.

1.3 Unless explicitly stated otherwise, any UC Berkeley IP shall be subject to terms of this License.

2 What you can’t do under this license

You may download the UC Berkeley IP only for official UC Berkeley campus use, or if such use is subject to a fully executed Trademark License Agreement, Sponsorship Agreement, or personal use subject to the terms of this License and where such use would not be commercial or infringe on the rights of others. You may not transmit the UC Berkeley IP to any party without express written permission by the Office of Marketing & Business Outreach (herein after “OMBO”).

You agree not to use the UC Berkeley IP in any manner:

2.1 That is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable;

2.2 To impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity;

2.3 To violate any patent, trademark, trade secret, copyright or other proprietary rights of any party;

2.4 To intentionally or unintentionally violate any applicable local, state, national or international law, University of California or University of California, Berkeley policies;

2.7 Except as expressly permitted in this License, you agree not to reverse engineer, de-compile, disassemble, alter, duplicate, modify, rent, lease, loan, sublicense, make copies, create derivative works from, distribute or provide others with the UC Berkeley IP in whole or part or transmit the material over a network, without express permission of the OMBO.

3. Grants

3.1 This License allows you to download and use the UC Berkeley IP on a single computer. This License does not permit you to download the UC Berkeley IP on more than one computer at a time. You may make one copy of the UC Berkeley IP for backup purposes only. You must include all the copyright notices from the Identity Resources Web site on the backup copy.

3.2. You may not use the UC Berkeley IP for any commercial purposes, including but not limited to, placement on merchandise for promotional use and resale, on non-Berkeley campus Web sites, in any print advertising, without the express written permission by the OMBO. Further, use of the UC Berkeley IP to endorse, sponsor or in any way indicate association with a business, individual, or service is strictly prohibited in accordance with the State of California Education Code 92000.

3.3 The University of California, Berkeley reserves the right to change or modify any of the terms and conditions of this license and any of the policies governing the UC Berkeley IP at any time in its sole discretion without direct notice to you. Your continued use of the UC Berkeley IP following these changes will constitute your acceptance of such changes.

4. Trademark and Copyright Infringement

4.1 This license authorizes you to use the University of California, Berkeley Intellectual Property alone. You may not combine any of the UC Berkeley IP with any trademarked or copyrighted material belonging to another. The UC Berkeley IP distinguishes the University’s services, products, and creative material from those belonging to other institutions, businesses, or individuals, and confer on the University the exclusive right to use the UC Berkeley IP.

4.2 As a condition to use the UC Berkeley IP, you agree that you will not use the UC Berkeley IP to infringe the intellectual property or other rights of others, in any way. The unauthorized copy, distribution, modification, public display, or public performance of copyrighted works is an infringement of the copyright holders’ rights.

4.3 Users are entirely responsible for their conduct and for ensuring that it comports with all applicable laws, including all copyright and trademark laws. In the event a user fails to comply with laws regarding copyrights or other intellectual property rights, such a user may be exposed to civil and criminal liability, including possible fines and jail time.

5. Termination

5.1 Your rights under this License will terminate automatically without prior notice from the University of California, Berkeley if you fail to comply with any term(s) of this License.
